The contract is between the Company and the Client (any person travelling or intending to travel on a tour operated by the Company). The contract, including all matters arising from it, is subject to the legal jurisdiction of Pune, Maharashtra, India.
You can make initial contact with the Company through phone (+91.966.508.1892), email or the contact form on the Company's website. Subsequent conversations can happen over email, phone or Skype as you prefer. Trips are booked with a 20% non-refundable deposit. The balance is payable 60 days prior to the trip start date. If the trip is within 60 days from date of booking, 100% of the trip cost is payable. All monies are payable by bank transfer (no charge) or PayPal, debit or credit cards (2.5% charge).
Prices indicated on the Company’s website are per person on twin-sharing basis, for a minimum group size of 4 and maximum group size of 12. Cost for groups smaller than 4 are approximately 20% higher and vary with trips. Sole-occupancy in rooms can be requested for an additional supplement. All tours are priced in local currency and are subject to currency fluctuations. You will be presented with accurate prices prior to your booking.
The price of your trip includes accommodation, contribution to organizations visited (if any), meals and transport from trip start point and to trip end point as listed in the pricing section of the trip detail. The price does not include items such as:
While the Company will endeavor to reserve rooms as per your choice (two single, one double, king/queen size bed, etc.), it will be unable to guarantee a particular room type on some segments of your journey.
Trips are priced from the starting point of the trip to the ending point, with all road, rail and air transportation included. Any transport and logistics to get to the start point and/or continue your journey from the ending point are not included in the trip cost. You can, however, request the Company to help you with these arrangements. The Company will, at its discretion, make these arrangements for you at cost for a small administration fee.
The Company does not book your international flights required to arrive in India. You are encouraged to buy travel insurance that covers possible trip cancellation.
Medical vaccinations, passports and visas are entirely your responsibility and must be arranged prior to departure. The Company can take no responsibility for cancellation of your trip in the event that you are not allowed to fly, or continue your tour. If you are unable to travel due to not being able to obtain (or not having) the appropriate visa, the Company reserves the right to retain the cost of the trip.
Once you have agreed on a tour and itinerary and received a confirmation from the Company, amendments at your request incur a charge of Rs. 2,500 per booking (Cancellation Charges may apply for amendments within 60 days of departure.)
Sometimes, it may be necessary or advisable for the Company to alter the arrangements for your holiday due to reasons such as increased risk of travel, change of schedule of partners, etc. The Company reserves the right to make such alterations as it deems necessary or advisable. If these alterations are significant, the Company will inform you as soon as possible and give you the choice to accept the revised arrangements or a full and prompt refund of all monies paid without interest payment.
No compensation will be paid at anytime under circumstances caused by war or threat of war, civil strife, industrial dispute, strikes, terrorist activity, accidents, natural or nuclear disaster, fire, airline failure, closure of airports, adverse weather conditions, or any other force majeure.
Should you wish to cancel your holiday, you must notify the Company as soon as possible in writing. The following cancellation charges apply, based on the number of days between your written notice and the start of your trip:
The Company will not cancel your holiday unless the client fails to pay the final invoice or due to force majeure. In such an event, the Company will return promptly all monies paid as shown on the account.
The Client acknowledges that they are responsible to make themselves aware through travel advisory bodies such as FCO Travel Advice, Travel Bureau of US Department of State or other sources available to them with regard to the safety of the areas in which they will be travelling and to make their decisions accordingly. The Client should also ensure that they are appropriately and adequately insured for this travel.
Your booking is accepted on the understanding that you realize the potential risks and hazards involved in adventure travel of this kind, including injury, loss or damage to property, discomfort and inconvenience. The Company will only accept your booking on the understanding that you realize the safety facilities in the developing world - in vehicles, on roads and at tourist sites - often do not match the conditions in the west. The Company accepts liability for any part of the tour not supplied as described in the itinerary. The Company, however, does not accept liability and/or compensation should there be no fault on the part of the Company or its suppliers and the reason for the failure in the tour arrangements was the client's fault, the actions of someone unconnected with the tour arrangements or could not have been foreseen or avoided by the Company or its suppliers even if due care had been exercised.
Where the client does suffer personal injury or death as a result of an activity forming part of the tour arrangements booked with the Company, the same rules shall apply.
The Company’s responsibility does not start until you meet at the designated start point overseas. The Company is not responsible for any additional expenses incurred by you in getting to the meeting point, although it can help you with these arrangements.
If a Client has a complaint against the Company the Client must first inform the tour guide or company representative whilst on the tour so the guide/representative can attempt to rectify the matter. If satisfaction is still not reached through these means then any further complaint must be put in writing to the Company within 30 days of the end of the tour. The Company will not accept any liability for claims received after the period.
Travel insurance is a mandatory requirement for all of tours. The Company strongly recommends that you purchase appropriate insurance once you have paid your deposit.
Adequate insurance must be in place before participating in a tour, which must include cover for medical expenses and repatriation costs should you become too ill to continue your trip. Proof of relevant travel insurance must be shown before departure.
The Company’s full Privacy Policy is published here and sets out what information the Company collects, how it collects it, and what it does with it. Your information refers to information such as your name, contact details, travel preferences and special needs, disabilities, dietary requirements that you supply or is supplied, including any information about other persons on your booking relating to the same ("your information"). Your information is collected when you request information from the Company, contact the Company (and vice versa) or make a booking with the Company. You are responsible for ensuring that other members of your party are aware of the content of the Company’s Privacy Policy and consent to your acting on their behalf in all your dealings with it. For the purpose of providing you with its services, the Company may disclose your information to service providers, such as hotels and taxis.
If you do not agree to the use of your information as above, the Company cannot do business with you or accept your booking.
The Company may from time to time contact you with information on new itineraries, special offers, brochures, or forthcoming events. Please note that the Company's website will assume you to agree to e-communications when you make a booking. You will be given the opportunity to indicate that you no longer wish to receive direct marketing material. Once properly notified by you, the Company will take steps to stop using your information in this way. The Company has taken all reasonable steps to have in place appropriate security measures to protect your information. Any changes to this Policy will be either posted on the Company's website, brochure and/or made available on request.
On a group holiday accompanied by a trip leader, it is necessary that you abide by the authority of the leader, who represents the Company. If you commit any illegal act when on the holiday or if in the reasonable opinion of the leader your behavior is disruptive, threatening or abusive or is causing or likely to cause danger, distress or annoyance to others the Company may terminate your travel arrangements without any liability on its part. In such circumstances no refunds or compensation will be paid to you and claims can be made against you for any costs and expenses incurred as a result of your behavior.
The accommodation arranged for you must only be used by those people named on your Confirmation Invoice (or on any Amendment Invoice issued). You are not allowed to share the accommodation or let anyone else stay there. You are responsible for the cost of any damage caused to your accommodation or its contents during your stay, except damage caused by persons not known to you. These charges must be met by you and may have to be paid locally.
If the Company issues detailed trip notes for your booking these trip notes and all the information contained therein will be deemed to be part of the contract. Trip notes contain up-to-date definitive information about the itinerary and travel arrangements. Should there be a discrepancy between the information in the brochure or website and the trip notes, the information in the trip notes supersedes that in the brochure or on the website and will be considered the most up-to-date and accurate.
The Company will consider special requests such as special dietary requests or, specific rooming requirements, when you book. It will tell you whether there is a charge for the request and can only guarantee requests for which there is a charge, or those that are confirmed in writing.
All Clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen holiday as described in the brochure. No unaccompanied minors (those under 18 years of age) can be accepted however (a) minors aged between 3 and 17 years may accompany their parents on tours made suitable for families, (b) older teenagers (those aged 14 and over) may be allowed to join certain group tours provided they are accompanied by a parent or guardian who accepts full responsibility for them.
Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the holiday. Failure to make such disclosure will constitute a breach of these booking conditions and may result in such persons being excluded from the holiday in which case all monies paid will be forfeit. If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the holiday, you must advise the Company of this at the time of booking.
Any likeness or image of you secured or taken on any of the trips may be used by the Company without charge in all media (existing or future) for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind such as brochures, slides, video shows or the internet. Any written feedback supplied to the company may also be used for promotional purposes as detailed above.
